Vnexia Terms of Use (User Agreement)

1) Eligibility (17+)

The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

2) The Service

Vnexia helps you organize and track your hairstyling journey, including creating structured hair profiles (with photos and details), tracking expenses, viewing a visual history, and reflecting on a timeline of previous looks.

We may add, remove, or modify features at any time.

3) Your Account

Registration: You may need an account to use certain features. You agree to provide accurate information and keep it updated.

Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us promptly of any unauthorized use.

4) User Content

Ownership: User Content includes text, photos, images, and other materials you upload, create, or store through the Service. You retain ownership of your User Content.

Your responsibilities: You represent and warrant that you have all necessary rights to submit User Content and that it does not violate any law or third-party rights.

License to operate the Service: You grant Vnexia a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, and display your User Content only as necessary to operate, maintain, and provide the Service and related support. This license ends when your User Content is deleted from the Service, except to the extent copies are required for legal compliance, backups, or dispute resolution.

5) Optional AI-Related Features

The Service may offer optional features that process text and/or images to help you organize or generate hairstyle-related content.

If you choose to use these features:

• Processing location: your uploaded text/images are processed on servers controlled by Vnexia Team.
• No third-party sharing: we do not share your uploaded text/images with third parties for these AI-related features.
• Ephemeral processing: we delete the uploaded text/images promptly after processing is completed.
• User control: you control whether to upload and whether to generate content.

If you do not use these features, you do not need to upload content for AI processing.

6) Acceptable Use

You agree not to:

• use the Service in violation of any law or regulation,
• infringe, misappropriate, or violate the rights of others (including privacy, publicity, copyright, or trademarks),
• upload content that is unlawful, harmful, abusive, harassing, hateful, or otherwise objectionable,
• attempt to interfere with, disrupt, or gain unauthorized access to the Service or its systems,
• reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law, or
• use the Service to develop or benchmark a competing product where prohibited by applicable law.

7) Intellectual Property

The Service, including its software, design, text, graphics, and trademarks, is owned by or licensed to Vnexia and is protected by applicable laws. Except for the limited rights expressly granted to you, we reserve all rights in and to the Service.

8) Third-Party Services and Apple

The Service may be distributed through Apple’s App Store. These Terms are between you and Vnexia, not Apple.

To the extent permitted by law:

• Apple has no obligation to provide maintenance or support services for the Service.
• In the event of any failure of the Service to conform to applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) in accordance with its policies; Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the Service, including product liability, legal compliance, or intellectual property infringement claims.
• You agree to comply with applicable third-party terms when using the Service.

9) Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe suspension is necessary to protect the Service, users, or our rights.

Upon termination, your right to use the Service will cease. Sections that by their nature should survive will survive.

10) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, Vnexia disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Vnexia does not provide professional advice. Any insights, summaries, or optional generated content are for informational and organizational purposes only.

11) Limitation of Liability

To the maximum extent permitted by law, Vnexia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, Vnexia’s total liability for all claims related to the Service will not exceed the amount you paid to Vnexia (if any) for the Service in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12) Governing Law and Dispute Resolution (Binding Arbitration)

These Terms are governed by the laws of Vnexia Team’s principal place of business, without regard to conflict of laws rules.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may seek injunctive or equitable relief for alleged infringement or misuse of intellectual property or confidential information.

Arbitration will be conducted on an individual basis and not as a class, collective, or representative action, to the extent permitted by law.

13) Changes to These Terms

We may update these Terms from time to time. We will update the Effective Date when changes take effect. Continued use of the Service after changes become effective means you accept the updated Terms to the extent permitted by law.
